End User License Agreement
- The purchase of any item from the Scottie Globemaster SDR web site shall invoke the purchaser and any subsequent owner in this End User License Agreement.
- The Purchaser shall be issued with a license to construct and operate the Scottie Globemaster SDR hardware.
- The Purchaser of the Scottie Globemaster SDR unit, or any of the component parts contained therein, shall be bound by the terms contained within this End User License Agreement (EULA) as specified in the following text.
- The Purchaser must have a valid amateur radio license whose call sign must be disclosed at the time of purchase.
- The Purchaser shall be responsible for ensuring that the Scottie Globemaster SDR hardware is constructed in accordance with the construction data provided and upon completion of the construction shall verify that the RF Spectral Emissions output from the hardware are compliant with the terms of the amateur radio license held by the purchaser.
- The Scottie Globemaster SDR EULA dictates that the purchaser, upon being issued with the proprietary technical information on the Electrical and Mechanical Design of the Scottie Globemaster SDR, shall agree to use this information in confidence for the purpose only for which it is supplied, specifically, to facilitate the activities contained within the Build, Test and Operation of the specific hardware provided of the Scottie Globemaster SDR.
- All product information issued to the purchaser is proprietary technical information that is Intellectual Property . This Intellectual Property shall remain the sole property of Andrew Kinsey and Edward Murphy (GM3SBC). This Intellectual Property shall be held by its recipient on a confidential basis and it must not be disclosed to any other party by any method, be it Verbal, Photographic, Physical or Electrical transfer.
- The Construction and Test data issued with any item of Globemaster hardware is copyright information that shall remain the Intellectual Property of Andrew Kinsey and Edward Murphy (GM3SBC).
- The entire Scottie Globemaster SDR Hardware Design Configuration is the Intellectual Property of Andrew Kinsey and Edward Murphy (GM3SBC) and is copyright. It is expressly prohibited that any part of this hardware design shall be copied or reverse engineered.
- The Scottie Globemaster SDR Hardware and Documentation must not be reproduced in whole or in part or used for tendering or manufacturing purposes except under agreement and with the consent in writing of Andrew Kinsey and Edward Murphy (GM3SBC) and then only on the condition that this notice is included in any such reproduction.
- Transfer of License, Hardware and Intellectual Property: In the event that the purchaser offers the Scottie Globemaster SDR hardware to a third party, this transfer shall be conditional on the purchaser being responsible for the Transfer of this License to the third party and the Acceptance of this License Agreement in its entirety by the third party.
- No Software application shall make reference to the Globemaster SDR unless the author of the software application has received prior recommendation and approval in writing by Andrew Kinsey and Edward Murphy (GM3SBC). This approval shall be conditional on the source code and executable files being made available for quality and functionality assessment.
- Resale of Globemaster Hardware for commercial gain shall not be permitted except under agreement, and with the consent in writing of Andrew Kinsey and Edward Murphy (GM3SBC).
- No item of Scottie Globemaster hardware shall be renamed and sold except under a license agreement with the consent in writing of Andrew Kinsey and Edward Murphy (GM3SBC).
- No commercial company shall place their name or logo in association with the Scottie Globemaster Hardware or open source or commercial Software except under agreement, and with the consent in writing of Andrew Kinsey and Edward Murphy (GM3SBC).
- Intellectual Property which has been supplied by Andrew Kinsey and Edward Murphy (GM3SBC) to software authors for the purpose of Scottie Globemaster Software Development shall remain the sole property of Andrew Kinsey and Edward Murphy (GM3SBC). This Intellectual Property shall include, but shall not be limited to, software algorithms, functionality specifications and related technical correspondence. This software development Intellectual Property must not be used with, or made available to, other hardware platforms except under agreement, and with the consent in writing of Andrew Kinsey and Edward Murphy (GM3SBC).
- Refusal of Sale of goods. Andrew Kinsey and Edward Murphy (GM3SBC) reserve the right to deny the purchase of Scottie Globemaster hardware and / or firmware to an individual and reserve the right to provide no reason for this refusal. Individuals who are known to be have been or are currently engaged in Violation of Copyright and or Violation of Software License Terms and Conditions shall be contained within but not limited to this category. Activities such as reverse engineering and refusal to release source code of open source software when requested shall be treated as serious violation of the terms and conditions of the license in which the software was originally supplied.
- Loan of Equipment. The purchaser may Loan the Scottie Globemaster SDR hardware to a third party. This transfer of equipment on loan shall be conditional on the purchaser being responsible for the Transfer of this License to the third party and the Acceptance of this License Agreement in its entirety by the third party.
- Repair of Equipment by a third party. The purchaser may engage an equipment repair facility to service the Scottie Globemaster SDR hardware. This transfer of equipment to the repair facility shall be conditional on the purchaser being responsible for the Transfer of this License to the third party and the Acceptance of this License Agreement in its entirety by the third party.
- Modifications to the Globemaster hardware which have been designed and implemented by the purchaser or a third party are done at their own risk. Any modification that a purchaser may deem worthy of distribution to other Globemaster owners must first submit the design data to Andrew Kinsey and Edward Murphy (GM3SBC) for general assessment of safety and functionality and for approval for distribution of the modification details to third parties.
- Damage to Property, Equipment or Personnel. The purchaser shall accept all risks and responsibilities during the operation of the Scottie Globemaster hardware including damage to Property, Equipment or injury to Personnel. The purchaser, or any subsequent owner, shall agree not to submit any claims against Andrew Kinsey and Edward Murphy (GM3SBC) for any such occurrence.
- Violation of End User License Agreement. In the event that there is a violation of this End User License Agreement the authors of the Scottie Globemaster Hardware and Firmware, Andrew Kinsey and Edward Murphy (GM3SBC), shall reserve the right to make public the violator(s) on a global scale. The authors of the Scottie Globemaster Hardware and Firmware, Andrew Kinsey and Edward Murphy (GM3SBC) shall also reserve the right to take legal action.
Warranty
The products, services and content on this website are provided “as is,” and Scottie disclaims all warranties, whether express or implied, including the warranties of merchantability and fitness for particular purpose. The Buyer acknowledges that it has not been induced by any statements or representations to the quality or condition of the goods and that no such statements or representations have been made. The Buyer acknowledges that it is their responsibility to ensure the suitablity of a particular product or service provided by Scottie.
